Terms and conditions

Terms of Trade – Mitchell’s Casual Letting By using the services of Mitchell’s Casual Letting, you agree to the following terms and conditions. These are designed to ensure transparency, professionalism, and mutual respect throughout the letting process. 

 

1. Scope of Service Mitchell’s Casual Letting provides casual tenant placement services only. We are not a full-service property management company. Our role ends once a suitable tenant has been secured and the tenancy agreement is signed, unless otherwise agreed in writing. 

 

2. Fees & Payment Establishment Fee: A one-off fee is charged for each successful tenancy arranged by Mitchell’s Letting. This will be confirmed in writing before services commence. Marketing Costs: Marketing and advertising costs may apply, depending on the strategy agreed upon. These will be pre-approved by the landlord. Due Date: All invoices are due within 7 days of issue. Late payment may result in administrative charges or interest (2% per month), and collection costs if applicable. 

 

3. Refund Policy Mitchell’s Letting does not provide refunds once a tenant has been successfully placed and a tenancy agreement signed. In the unlikely event that a tenant fails to move in or cancels before the tenancy starts, Mitchell’s Letting will make reasonable efforts to find a replacement at no additional cost to the landlord, provided the circumstances are not due to the landlord withdrawing the property or changing the terms. Any refunds or partial credits outside these situations are at Mitchell’s Letting’s sole discretion. 

 

4. Tenant Screening We carry out reference checks, credit checks, income verification, and general suitability assessments. Final tenant approval always remains with the landlord. While we strive to find reliable tenants, Mitchell’s Letting cannot guarantee long-term behaviour or performance once the tenancy begins. 

 

5. Cancellations If the landlord cancels the letting process after tenant sourcing has begun or a suitable tenant has been secured, a cancellation fee may be charged to cover time, advertising, and administrative costs. This will be discussed on a case-by-case basis. 

 

6. Legal Compliance Mitchell’s Casual Letting operates in compliance with the Residential Tenancies Act 1986 (NZ) and any amendments, as well as Tenancy Services New Zealand guidelines. Landlords are expected to ensure their properties meet Healthy Homes Standards and any local or regional compliance requirements. 

 

7. Dispute Resolution We aim to resolve any issues quickly and fairly: In the event of a disagreement between Mitchell’s Letting and a client, we encourage open communication as the first step. If resolution cannot be reached informally, both parties agree to enter mediation before pursuing any legal action. Any unresolved disputes may be addressed through the Disputes Tribunal of New Zealand or other appropriate legal forum. 

 

8. Confidentiality All client and tenant information is kept strictly confidential. We take privacy seriously and comply with the Privacy Act 2020. 

 

9. Limitation of Liability Mitchell’s Letting is not liable for any damages, losses, or expenses arising from tenant behaviour, unpaid rent, damage to property, or tenancy-related disputes after the placement is complete. The landlord accepts these risks as part of the rental process.
